Abstract : زنان، در كشور پهناوري همچون هند كه نيمي از جمعيت آن را تشكيل مي دهند، همواره مورد تبعيض و نابرابري با مردان واقع شده اند و هيچگاه از جايگاه اجتماعي و سياسي مساوي با مردان بهره مند نبودند. اين شمار عظيم زنان مي توانند نيروي بالقوه ي عظيمي در راستاي ايجاد رشد و توسعه همه جانبه هند در مرحله نخست و نهايتا كليه كشورهاي جهان باشد. در جامعه ي مرد سالار هند حقوق و جايگاه زنان هيچگاه مورد احترام واقع نشده است زيرا كه همواره فرهنگ و سنت و قواعد مذهبي غالب در جامعه از اهميت بيشتري نسبت به چارچوب هاي قانوني برخوردار بودند كه در نتيجه اين امر كليه حقوق سياسي و اجتماعي آنها نيز به فراموشي سپرده شده اند. دراين راستا، محقق سعي در پي بردن به نقش قانون اساسي هند درجهت ارتقاي جايگاه اجتماعي و سياسي زنان هندي از زمان استقلال هندوستان را دارد. اين تحقيق همچنين به اصلاحيه هاي قانون اساسي هند در راستاي فهم هر چه بيشتر تاثيرات آن خواهد پرداخت. در اين تحقيق، محقق تلاش خواهد كرد تا سوالات و فرضيه ي اين پژوهش را در قالب روش كيفي انجام و به سوالات اين تحقيق جواب دهد، لذا لزوما اين تحقيق به دنبال اثبات يا رد نظريه خاصي نمي باشد. يافته هاي اين تحقيق نشان مي دهد كه اصلاحيه هاي قانون اساسي هند بر بهبود جايگاه سياسي و اجتماعي زنان هندي تاثير نسبي داشته است. هرچند برخي از موانع مهم موجب كندي بهبود كلي جايگاه زنان گرديده است. نتيجه گيري كلي اين اثر بر اين مبنا مي باشد كه هر چند برخي قوانين، مقررات و اصلاحيه ها به بهبود اين وضعيت كمك كرده اما اين روند ناكافي و كند بوده است. اين تحقيق همچنين بيانگر اين مي باشد كه گام هاي اساسي در اين راستا برداشته شده و اينكه اين مسير در جهت درستي قرار دارد وليكن برخي اقداماتي نياز است تا اين روند را تسريع و نواقص را مرتفع نمايد.
: Women, who constitute half of the population of a large country like India, have been ignored and did not enjoy an equal or similar status comparing to men. This large number of people could have been a great potential that would serve Indian prosperity and consequently the whole world. Women’s rights and status have not been respected in patriarchal society of India; in addition cultural, traditional and religious norms are usually given more priority by Indian society, rather than laws, regulations and legal frameworks therefore, fundamental rights and desired political and social status of women have been ignored. Through studying the process of evolution of Indian women rights and status since the time of independence, this research tries to find out how much Indian Constitution could defend rights of Indian women and how important was the status of Indian women after that. Moreover, this research studies the Constitutional Amendments in order to understand the effectiveness of these Amendments for enhancement of social and political status of women in India. As this thesis is trying to discover the answers of the questions and testify the hypothesis thorough a qualitative approach therefore, the researcher does not tend to apply any specific theory to this research and the whole study will be framed accordingly. The current research finds out that Constitutional Amendments have had relative effects to improve political and social status and rights of women in India. Nonetheless a series of major obstacles halted total enhancement of Indian women status. The research concludes that although some laws, regulations or Constitutional Amendments have contributed to the improvement of women’s social and political status in India, but the process is incomplete and slow. This research point out that several critical steps have been taken and the evolution of Indian women rights and status is on the right path but some measures are required to speed up the process and to reform the shortcoming.
